OOIDA filed its legal challenge with the 8th Circuit Court of Appeals on Nov. 11, seeking to vacate the rule either in part or in whole. OOIDA contends that the final rule added an appendix that wasn’t included in the agency’s 2014 proposal of the rule that could subject some truckers to sleep apnea screening.
