Auto Safety Advocates Sue Feds, Asserting Failure To Follow Congressional Safety Requirement

Two consumer groups are suing the federal government, saying it has endangered the public by failing to follow a Congressional mandate.

That mandate is to require automakers to install a device that would remind occupants in the back seat to buckle up.

The suit says seat belts are proven lifesavers and following the Congressional directive would save “thousands of lives each year, including those of young children, and prevent many other thousands of people, including children, from experiencing physical injuries, pain, and suffering.”

Such belt reminders are already required for front seats. But in 2015 only about three percent of the models had them for the rear seats, according to the Insurance Institute for Highway Safety.

The suit was filed by The Center for Auto Safety and Kids and Cars Incorporated against the National Highway Traffic Safety Administration and its parent, the U.S. Department of Transportation.

“To have to bring a lawsuit in federal court to compel NHTSA to simply write a regulation required by law – one that is widely recognized as having significant lifesaving potential – is, to use a word, sad,” Jason Levine, the new executive director of the Center for Auto Safety, said in a statement.
