A. While most CDL drivers will be required to use an ELD to record HOS, there are some drivers who will be exempt. Drivers who use the timecard exemption will not be required to keep RODS or use an ELD. Drivers who will have to keep RODS either on paper, using an Automatic On-Board Recording Device (AOBRD), or a logging software program but will not be required to use an ELD include:
- Drivers who use paper RODS not more than 8 days out of every 30-day period (this does not have to be a calendar 30-day period; e.g., it could cover July 15-August 15, and still be covered under this exemption).
- Drivers who conduct drive-away-tow-away operations, where the vehicle being driven is the commodity being delivered.
- Drivers of vehicles manufactured prior to 2000.
